DMCA Policy

This Digital Millennium Copyright Act policy (“DMCA Policy”) applies to the EVS Buzz Jobs website (https://job.evsbuzz.com/), owned and operated by Softist Services Pvt Ltd, and describes how we address copyright infringement notifications and how you, as a copyright owner, can submit a complaint.

Protection of intellectual property is of the utmost importance to us and we ask our users and their authorised agents to do the same. What to Consider Before Submitting a Copyright Complaint

Before submitting a copyright complaint to us, consider whether the use could be considered fair use. Fair use states that brief excerpts of copyrighted material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching and research, without the need for permission from or payment to the copyright holder.

Notifications of Infringement

If you are a copyright owner or an agent thereof and believe that any material available on our website infringes your copyrights, then you may submit a written DMCA notice by providing our designated DMCA agent with the following information in writing (see 17 U.S.C 512(c)(3) for further detail):

  • A physical or electronic signature of a person authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
  • Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.
  • Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (for example, the exact URL of the page on EVS Buzz Jobs).
  • Information reasonably sufficient to permit us to contact you, such as an address, telephone number and email address at which you may be contacted.
  • A statement that you have a good-faith belief that use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.

Counter-Notification Procedures

If you believe that material identified in a notice of infringement has been removed or disabled by mistake or misidentification, you may file a counter-notification with us by providing the following information in writing to our designated DMCA agent:

  • Your physical or electronic signature.
  • Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
  • A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • Your name, address and telephone number, and a statement that you consent to the jurisdiction of the courts in the district in which the address is located, and that you will accept service of process from the person who provided notification of the alleged infringement.

Repeat Infringers

EVS Buzz Jobs maintains a policy of terminating the accounts of users, contributors or account holders who are repeat infringers of copyright and other intellectual property rights of others.
